The Roe VIP Membership terms and conditions

1. Introduction
1.1. These terms and conditions (“Terms”) govern the membership program (“Membership”) offered by The Roe Australia (“Restaurant,” “we,” “our,” or “us”) to individuals or entities (“Member,” “Member,” or “Memberr”).
1.2. By applying for and using the Membership, Member agree to comply with these Terms. Please read these Terms carefully before applying for Membership.

2. Membership Application and Eligibility
2.1. Membership is open to individuals aged 18 years and above. The Roe Australia reserves the right to require proof of age of the applicant prior to the applicant being considered for Membership.
2.2. To apply for Membership, Member must complete the Membership application form provided by the Restaurant, which may include personal information.
2.3. The Roe Australia reserve the right to decline any Membership application at our discretion.
2.4. An applicant who is an Employee is not permitted to join or maintain Membership or participate in any activities relating to The Roe Australia.
2.5. Membership is granted upon making a qualified purchase.
2.6 Points cannot be redeemed once they have expired. The Roe Australia reserves the right to reverse or cancel any Points credited to a Member incorrectly, or not in accordance with, or in breach of, these Rules at any time.

3. Points
3.1. Points and Privileges that The Roe Australia has made available to a Member are not transferable and cannot be used by any person other than the Member named on system who has accumulated those Rewards (except where approved by The Roe Australia in its sole discretion).
3.2. Reverse points may occured where a transaction is cancelled or a refund given. The Roe Australia may correct erroneous, invalid points or adjust for reversed transactions at any time even if it would put Memberr membership account into a negative points balance.
3.3. Member cannot transfer, sell, or give points to any other person.
3.4. Points have no cash or monetary value.

4. Membership Tiers
4.1 A Member will be assigned a Tier based on the points they have earned in a Membership Cycle.
4.2 There are Four Membership Tiers in the The Roe Australia loyalty program. The entry Tier is Member Tier. All new Members will be automatically assigned to the entry Tier unless otherwise determined by The Roe Australia in its sole discretion. Members may progress to higher Tiers by earning points or reload.
4.3 Membership Tiers are valid for one Membership Cycle. There are one (1) membership cycles (each a “Membership Cycle”): 1 January. Any points earned during a Membership Cycle qualify the Member for the applicable Tier in the following Membership Cycle.
4.4 In the case of new Members, a Member’s first Membership Cycle commences on the commencement date of the then-current Membership Cycle and expires after that Membership Cycle.
4.5 At the end of an applicable Membership Cycle, a Member’s points will be reset to zero.
4.6 A Member will be eligible for Privileges based on the Status Credits earned in the preceding Membership Cycle subject to these Rules. Members are eligible for Membership Benefits and Rewards at the applicable Tier for a minimum of one Membership Cycle.
4.7 Members will be reallocated to the appropriate Tier if a Member does not meet their current Tier’s minimum entry-level requirements at the end of the applicable current Membership Cycle.
4.8 If upgrading to a new Tier during a Membership Cycle, Benefits and Rewards for that Membership Cycle will be issued pro rata and cannot exceed that of the new Tier.

5 Termination of Membership
5.1. The Roe Australia reserve the right to terminate or suspend Membership at our discretion, with or without cause.
5.2. Member may also choose to terminate Membership at any time by notifying in writing.

6. Privacy and Data
6.1. The Member agrees that The Roe Australia will hold their personal information in a database that will include, but not be limited to, the Member’s name, address, date of birth, telephone number(s), identification details, biometric information if applicable and any other information relating to the Member which The Roe Australia has collected by lawful or authorised means, including information collected in connection with The Roe Australia Rewards.

7. Promotional and marketing communications
7.1 The Member’s marketing preferences are those selected during their application process or as otherwise updated or advised by the Member from time to time.
7.2 The Member may, at any time, elect to opt-out of receiving any further promotional material from The Roe Australia by telephoning The Roe Australia at 03 5611 3330 or writing to The Roe Australia at member@theroe.com.au

8. Termination of operation of The Roe Australia Rewards
8.1 The Roe Australia may suspend the operation of The Roe Australia Rewards or cease to operate The Roe Australia Rewards at any time.
8.2 If The Roe Australia Rewards ceases to operate, all Points that have not been exchanged for currently available Awards within three (3) months of The Roe Australia issuing a notice to Members that The Roe Australia Rewards will cease to operate will be cancelled. In addition, all other Rewards which have been accumulated in connection with The Roe Australia Rewards will be deemed to be cancelled if they have not been used by such date.

9. Liability
9.1 Nothing in these Rules is intended to affect any rights that a Member may have including under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), the Australian Consumer Law and Fair Trading Act 2012 (Vic), the Fair Trading Act 2010 (WA) and the Fair Trading Act 1987 (NSW) which cannot be excluded. By way of example, as a consumer, a Member has the benefit of certain consumer guarantees which cannot be excluded by a provider of goods or services.
9.2 Subject to Rule 9.1 and to the extent permitted by law, The Roe Australia and its Related Bodies Corporate (including its officers, employees, agents and contractors) are not and will not be liable for any damages or any other loss incurred by the Member (including consequential loss), either directly or indirectly in connection with these Rules or The Roe Australia Rewards (including, without limitation, changes to the Rules or The Roe Australia Rewards), except to the extent caused by the negligence, wilful misconduct or wrongful act or omission of The Roe Australia and its Related Bodies Corporate or its officers, agents or employees.

10. General
10.1 The Roe Australia’s decisions in respect of The Roe Australia Rewards are final and binding.
10.2 Any tax liabilities and other duties arising from the accumulation and redemption of Points and the receipt and use of Privileges are and remain the sole responsibility of the Member. Furthermore, The Roe Australia recommends Members seek independent tax advice about any tax consequences of the accumulation and redemption of Points and Benefits.
10.3 Any alteration made to Associated Documentation by any person other than The Roe Australia may have the effect of automatically invalidating that Associated Documentation. Associated Documentation cannot be replaced or Points re-credited if such Associated Documentation is lost, stolen, damaged or destroyed and should be kept in a safe place and in good condition by the Member.
10.4 In consideration of The Roe Australia admitting the Member to Membership of The Roe Australia Rewards and by use of the Card or any Linked Online Account (whichever first), the Member agrees to be bound by these Rules and acknowledges the right of The Roe Australia to rely upon them as an indication of the Member’s consent to any acts authorised or contemplated by these Rules.
10.5 For the avoidance of doubt, The Roe Australia reserves its right to waive in respect of any Member or Members (at The Roe Australia’s absolute discretion) any right or requirement of these Rules and/or the application of, or compliance with any of these Rules. Any such waiver does not operate as a waiver of such right, requirement, application or compliance if it arises again.
10.6 This document is governed by the laws of the State. Each party submits to the jurisdiction of the courts of that State and of any court that may hear appeals from any of those courts, for any proceedings in connection with these Rules.
10.7 To the extent that any provision in these Rules is illegal or unenforceable, it is severed without affecting the validity or enforceability of the remaining Rules.

By submiting the form, I acknowledge that I have read and understood the terms and conditions set forth by The Roe Australia and agree to abide by them. I acknowledge that I am aware of and consent to the marketing activities conducted by The Roe Australia, which may include, but are not limited to, promotional emails, newsletters, special offers, and other marketing communications.
